Vấn đề là, phải theo luật nào đây.
Nếu thưa theo Luật chống malpractice (v́ cô này cũng là bệnh nhân tại bệnh viện này), th́ không được, v́ không đủ 3 điều kiện:
1. Bệnh viện CỐ T̀NH làm sai;
2. Việc làm sai này gây hại cho cô Nina
3. Cô Nina suffers, is injured, bởi việc này.
Nếu theo luật này, th́ bên nguyên đơn chỉ có thể chứng minh (2) và (3).

Như vậy, chỉ có thể thưa bệnh viện tội NEGLIGENCE.
Tội này h́nh thành khi người nào đó do không thi hành đúng nghĩa vụ của họ đă gây ra thiệt hại cho người bị hại.
Ví dụ ai đó không cắt cành cây, để rơi trúng xe người đang chạy trên đường công cộng. Trồng cái cây, tức là có implied responsibility phải cắt cành cây khi chúng mọc dài ra. Nếu trong vài tuần trước đó chủ nhà thuê 1 cty cắt cành cây, có license, cắt các nhánh dài, th́ cho dù cành cây rớt trúng xe người chạy ngang th́ VẪN KHÔNG BỊ ĐỀN BÙ.
Nhưng bệnh viện này đâu có chuyên khoa trị Ebola, do đó họ không có expressed or implied responsibility phải chuẩn bị các cô nurse cho việc chữa trị bệnh này.
Họ chưa từng quảng cáo có thể trị bệnh này, và cũng chưa từng quảng cáo "có thể trị hết, có y tá, chuyên đặc trách trị tất cả mọi bệnh truyền nhiễm".
Do đó, luật sư cô Nina phải tố cáo rằng, bệnh viện đă NEGLIGENCE v́ đă không thực thi EXPRESSED OR IMPLIED RESPONSIBILITY trong việc chuẩn bị đầy đủ cho các cô y tá để họ giúp bệnh nhân Ebola.
Và điều tranh căi sẽ là, "expressed or implied responsibility" trong vụ này ra sao.
Bên bị đơn sẽ tranh luận, họ không phải là bệnh việc đặc trách chữa trị Ebola. Tại Mỹ CHỈ CÓ 5 TRUNG TÂM CHUYÊN TRÁCH TRỊ EBOLA mà thôi.
Do đó, họ không có expressed responsibility, cũng không có implied responsibility, trong việc chuẩn bị đầy đủ cho tất cả mọi nhân viên chống lại bị Ebola lây nhiễm.

HSKhuya chắc chưa phải ngồi nhà mấy tháng, và có thể suốt đời ôm bệnh, chẳng làm ǵ được.
Và chắc chưa từng bị PTSD - post traumatic stress disorder.

Mỗi năm cô này làm nurse kiếm khoảng 70 ngàn đô, nếu không làm việc được tới 67 tuổi sẽ bị mất 70 x 41 = $2.870.000.
Chưa kể mất niềm vui, tự hào khi làm việc.
Ngồi nhà 41 năm, không điên cũng khùng.
Ngoài ra c̣n ôm đủ loại bệnh, do có lẽ GAN và THẬN bị hư hại, do uống, chích quá nhiều liều thuốc cực mạnh.
Gan có hơn 2000 chức năng. Gan hư, coi như hư luôn con người. Và con người chỉ có 1 cuộc đời.

Chúng ta buồn, nhưng nên thông cảm cho Nina.
Chưa ở vào hoàn cảnh cô này, th́ đừng nên phán đoán quá nặng.
Tiền có vài triệu, chỉ là an ủi.
Rủi ra ṭa bị thua, th́ càng thê thảm.
Cho dù thắng, được an ủi về tiền xài, nhưng mất danh dự, cuộc đời hết vui thú v́ không c̣n khả năng làm việc, ngồi nhà ôm bệnh th́ coi như cũng THUA cuộc đời này.
Nguời ở tù, sau khi trở ra nếu c̣n sức khoẻ th́ c̣n "làm lại cuộc đời".
Cô Nina mất sức khoẻ là MẤT TẤT CẢ.
Tôi vô cùng thông cảm cho Nina.

Bà nói tiếp, “Những ǵ thực sự xảy ra tại bệnh viện Texas Health Presbyterian cần phải được cho nhiều người biết để các bệnh viện khác học hỏi. Hy vọng, những ǵ xảy ra cho cô Nina sẽ không bao giờ xảy ra cho các y tá khác.”
“Tôi rất ngưỡng mộ cô Nina dám đưa đơn kiện,” Luật Sư Charla Aldous nói tiếp.
Ông Tom Hà, phó chủ tịch Cộng Đồng Người Việt Quốc Gia tại Tarrant County, Texas, nơi gia đ́nh cô Nina Phạm cư ngụ, hoàn toàn ủng hộ quyết định của cô.
Ông nói, “Rơ ràng là bệnh viện Texas Health Presbyterian đă không chuẩn bị đầy đủ cho các y tá, hoặc cũng có thể v́ hai cô y tá bị nhiễm bệnh là người gốc thiểu số, một gốc Việt, một gốc Châu Phi. Vụ kiện này không phải v́ tiền, và tôi có bàn với gia đ́nh của cô Nina là bệnh viện này ở đây lớn lắm. Bệnh viện lớn mà c̣n như vậy, thử hỏi các bệnh viện nhỏ th́ sao?”
“Vụ kiện này là tấm gương cho tất cả các bệnh viện. Đây là bệnh Ebola, nếu xảy ra một vụ khủng bố lớn th́ biết làm sao đây,” ông Tom Hà nói tiếp. “May mà cô Nina c̣n sống, nếu chết rồi th́ thôi chứ làm ǵ được. Cũng may là có mọi người cầu nguyện, và cô c̣n sống, để bảo vệ không những cho y tá, và cho tất cả bệnh nhân.”
Ông Nguyễn Kim Khoa, cựu chủ tịch Cộng Đồng Người Việt Quốc Gia Vùng Central Valley, California, hiện cư ngụ ở Fresno, cũng ủng hộ cô Nina Phạm.
Ông nói, “Tôi ủng hộ cô Nina Phạm trong chuyện này, v́ đây là một hành động bảo vệ quyền lợi của người Việt chúng ta. Một số bà con chúng ta chưa trải qua những ǵ cô Nina trải qua, nên có thể họ chưa hiểu cô bị tổn thương như thế nào.”
“Tôi từng bị đụng xe, chỉ bị thương nhẹ thôi, nhưng bây giờ, mỗi lần đi ngang qua chỗ đó, vẫn cảm thấy rùng ḿnh,” ông Khoa
