California SB 54: Sanctuary State Bill
Hôm thứ 5 vừa qua, Thống Đốc California Jerry Brown vừa kư 1 đạo luật gọi là SB 54. Đây là đạo luật gọi nôm na là "sanctuary city." Đạo luật này ngăn cấm các cơ quan cảnh sát tại CA giúp đở các nhân viên ICE trong việc lùng bắt những người di dân lậu đang sinh sống tại CA. Đạo luật này do Kevin De Leon, người đứng đầu Thượng Viên của California. Điều này khá dể hiểu v́ De Leon vốn là Mễ, và theo chính miệng De Leon nói th́ gần nhưn 1/2 gia đ́nh của ông ta là người di dân lậu. Danh từ Sanctuary State, City là một tiếng lóng nói lên sự phản đối của một số thành phố hay tiểu bang về việc hồi hương những người di dân lậu. CA không phải là tiểu bang duy nhất chống đối Trump trong việc hồi hương những người di dân này. NY và Chicago cộng thêm một số tiểu bang và thành phố cũng có những đạo luật tương tự. Tuy nhiên, CA là tiểu bang duy nhất có đạo luật này áp dụng cho toàn tiểu bang.

Để trả đũa lại đạo luật SB 54 của CA vừa được Brown kư, Tom Homan, giám đốc của ICE, tuyên bố rằng ICE sẽ tăng cường tuần tra CA gắt gao hơn nữa. Homan cũng cảnh cáo rằng v́ chính sách này cho nên sẽ có nhiều người khác sẽ bị liên lụy, cho dù ICE không có y bắt họ. Lư do là nếu CA không chống đối th́ các tù tại CA có thể liên lạc ICE khi có tội phạm mà ICE cần. Bây giờ chính ICE phải ra tay. Cho nên họ có thể tung cái lưới rộng hơn, không chỉ đơn giản chú trọng riêng vào những kẻ phạm tội

DACA: Deferred Action of Childhood Arrival
DACA là một chương tŕnh được dựng lên bởi Obama vào năm 2012 để hợp thức hóa, ít nhiều, số người di dân lậu ở Mỹ theo chân Cha Mẹ sang đây lúc c̣n nhỏ. Số người đó bây giờ đă trưởng thành, nhưng không thể đi hội nhập vào xă hội một cách công khai chính thức. Lư do là họ không có giấy tờ hợp lệ. Vào tháng 6, 2012 Obama ra một lệnh (Executive Order) để cho phép số người này được hợp thức hóa một phần. Trước đó, Obama cố gắng thông qua Quốc Hội một đạo luật di dân để cho phép những người này có thể sinh sống tại đây 1 cách hợp lệ, với viễn ảnh sẽ trở thành công dân nếu họ có một cuộc sống đàng hoàng. Tuy nhiên, Quốc Hội không chấp nhận v́ sự phản đối của các tiểu bang thuộc Đảng CH. Dân Chủ cũng có nhưng không nhiều bằng. Rốt cuộc để được tái cử nên Obama chơi cái t́nh Executive Order. Lệnh này có hiệu lực 5 năm, kể từ tháng 6 2012. Vào tháng 6 năm nay 2017 th́ hết hạn. Trump có thể gia hạn, nếu muốn. Nhưng Trump không gia hạn và đẩy vấn đề này sang Quốc Hội, viện lư do là chỉ có Quốc Hội mới có thể giải quyết vấn đề di dân một cách hợp pháp lâu dài.
Tuy nhiên, Quốc Hội của năm 2012 là một QH với Đảng DC nhiều hơn bây giờ và TT là một trong những người ủng hộ di dân lậu nhất so với hiện tại mà vẫn không thể thông qua được 1 đạo luật về di dân th́ thử hỏi sát xuất của một đạo luật di dân đó có thể thông qua QH hiện tại sao? Trump đẩy vấn đề này sang bên đó, kèm theo những điều kiện liên quan đến vấn đề di dân. Một trong những điều kiện đó là QH phải cho phép Trump xây bức tường. Bù lại Trump sẽ kư vào đạo luật để hợp thức hóa đám người này.
"Hợp thức Hóa" là một danh xưng chung. V́ ba chữ này có rất nhiều nghĩa khác nhau. Cái ǵ gọi là "hợp thức hóa?" Được đi làm và sinh sống tại đây là một. Được thành công dân là 2. Nhưng sự khác biệt giữa 1 và 2 rất lớn. Làm công dân là ước mơ của tất cả. Tuy nhiên, nếu được ở lại và đi làm đàng hoàng th́ cũng tốt. Đám người này họ không mong ǵ hơn nếu được 1 hoặc 2. Biết rỏ đảng DC rất muốn thông qua vấn đề này nên Trump, đúng phong cách của một tay chuyên môn thương lượng, đặt vấn đề này với các hàng lănh đạo của đảng DC. Thoáng nh́n qua th́ người ta rất ngạc nhiên khi thấy Trump, vốn b́nh thường là một dân quậy, tự nhiên hôm nay rất đàng hoàng. Tuy nhiên, khi nh́n vào những ǵ Trump đ̣i hỏi th́ vấn đề không dể như người ta tưởng. Trump cho QH 6 tháng kể từ tháng 9 năm 2017 cho đến tháng 3, 2018 để giải quyết.
Tôi sẽ update vấn đề này mỗi khi có tin tức ra. Các cộng đồng di dân tại Mỹ hầu hết ai cũng dính líu ít nhiều tới vấn đề này. Người VN cũng thế. Đọc trên các báo VN th́ ít thấy ai nói tới.
RAISE ACT--Reforming American Immigration for Strong Employment
Đây là một đạo luật hiện đang được tranh cải tại Quốc Hội liên quan đến vấn đề di dân trong tương lại. Trump và các dân biểu cũng như Thượng Nghị Sĩ CH đang muốn cải tổ lại chương tŕnh di dân vào Hoa Kỳ. Họ muốn loại bỏ những thành phần sang đây vốn chỉ là gánh nặng cho xă hội như người già, người không biết tiếng Anh, hay không có nghề nghiệp vững chắc, hoặc những người không có những nghề chuyên môn cao cấp. Đây là một dạng chọn lựa những thành phần thượng hảo hạn của các quốc gia khác để cho vào. Luật này c̣n đang tranh cải, chưa thành luật (Bill mà thội.)
Vấn đề này cũng là một trong những vấn đề ảnh hưởng rất mạnh tới việc định cư của tất cả các sắc dân khác trên thế giới muốn vào Mỹ. VN dĩ nhiên cũng không ngoại hạng. Nếu đạo luật này được thông qua th́ có thể nói rằng mấy thằng VC chắc hết cách sang đây. V́ đây lựa chọn những người với nghề chuyên môn. [B]Đục khoét tài nguyên quốc gia rồi tẩu tán, hay có khả năng bán nước có văn kiện không tính nhé[/B]. Không rỏ đạo luật này có ảnh hưởng ǵ tới các chương tŕnh E 5, E 3 ǵ đó không.
